Privacy Policy for Uppit

This Privacy Policy describes how Emberex, Inc. (“Emberex,” “we,” “us,” or “our”) collects, uses and protects your personal information. When you submit personal information to Emberex through Uppit or any related web pages, products or services (collectively, "Products") by email, by phone, by mail, or when you use or access our Products, you are consenting to the collection, use, transfer and disclosure of your personal information as described in this Privacy Policy. 1. Information Emberex Collects

When you submit information to Emberex via our Products, or otherwise correspond with Emberex, Emberex receives and stores that information. Personal information includes any information you provide Emberex that could reasonably be used to personally identify you. It does not include any content that you post through our Products or provide to Emberex for posting to the same, even if such content contains personally identifiable information.

Our Products include an interactive mobile application that allows users to view and share photos and locations. When you post a photo, it will be shared with other users of the application, so it is important to remember to only post photos that you want to be shared.

Our application is intended for a general audience and Emberex does not knowingly collect personal information from children under the age of 13. If we learn that we have collected such children’s personal information without parental consent, we will delete such information from our system. If you learn that your child has provided us with information, please let us know.

When you visit or use our Products, our web server automatically receives and records certain information that your device provides, including a universally unique identifier (UUID), precise location permission (non-continuous), camera permission, geographic position, and camera data.

Any use of Cookies – or of other tracking tools – by this Application or by the owners of third-party services used by this Application serves the purpose of providing the service required by the User, in addition to any other purposes described in the present document and in the Cookie Policy, if available.

Users are responsible for any third-party Personal Data obtained, published or shared through this Application and confirm that they have the third party's consent to provide the Data to the Owner.

This application does not support “Do Not Track” requests. To determine whether any of the third-party services it uses honor the “Do Not Track” requests, please read their privacy policies.

2. How Emberex Uses Your Personal Information

The information Emberex collects is used to provide its services, as well as for the following:

Device permissions may be requested by the user’s device, in order to allow the device to access the user’s device data. Camera permission allows access to the camera. Precise location permission (non-continuous) allows access to the user’s precise device location in a manner that isn’t continuous. This means that it is impossible for the application to derive the exact position of the user on a continuous basis. Device permissions may be required in order for the application to function properly, and they may be revoked by the user at any time. If the user grants any of the permissions requested by the application, the respective Personal Data may be collected and processed by this application.

When requested by the user, photos may be uploaded to a web server and shared with other users of the application, along with the user’s geographic location at the time the photo was uploaded.

Emberex may also disclose personal information to third parties with your consent or under the following circumstances:

Emberex may disclose your personal information to service providers and consultants who are under contract with Emberex in order to assist with Emberex business operations, such as mail delivery, technical support, and operating or improving our Products.

From time to time Emberex may be involved in some form of business transfer, whether it is a merger, acquisition or some form of asset sale or a sale of its Products. In connection with such activity, user information, including your personal information, may be provided to entities and advisors involved in the business transfer, subject to an obligation to keep your personal information confidential.

Emberex may disclose your personal information when Emberex believes in good faith that such disclosures: (a) are required by law, including, for example, to comply with a court order or subpoena; (b) will help enforce Emberex’s Terms of Use; or (c) are necessary to protect your safety or security and/or protect the safety and security of Emberex, its Products, the property or employees of Emberex, or third parties.

Emberex does not sell or provide your personal information to third party advertisers.

3. Changing or Updating Your Information

You can obtain access to the personal information Emberex currently has on file for you and/or correct inaccuracies in such personal information by making a written request to Emberex by mail or e-mail. For your protection, you may be asked to provide additional information to verify your identity before being granted access to your personal information. You can also update your personal information by signing into your user account, if you have one.

California Residents: Under California Civil Code sections 1798.83-.84, California residents are entitled to ask for a notice identifying the categories of personal customer information that we share with our affiliates and/or third parties for marketing purposes, and providing contact information for such affiliates and/or third parties. 4. How Emberex Protects Your Personal Information

Emberex and its third-party hosting service providers have security measures in place at their physical facilities to protect against the loss, misuse or alteration of personal information collected from you. When Emberex or its third-party hosting service providers transfer and receive certain types of sensitive information online, such as financial information, visitors are redirected to a secure server. However, due to computer hackers, electronic malfunctions, and other events, Emberex cannot guarantee that such safeguards will always protect such information.

Certain portions of our Products may only accessible by registered users who have an account. Your account can only be accessed by entering the correct password. You are solely responsible for protecting your password, and you should not share your password or personal information with others. Please remember, we will never ask you for your password.

5. Updates

Please visit this Privacy Policy from time to time, as Emberex reserves the right to periodically update it. When the Privacy Policy is changed in a material way, we may provide you notice through your user account or the e-mail address you provided us along with the updated Privacy Policy. Your continued use of our Products after an update to this Privacy Policy indicates your acceptance of the terms of the updated Privacy Policy.

The Products may contain links to external websites and users may also post links to external websites. Emberex is not responsible for the privacy practices or the content of such websites. You should check the applicable privacy policies of the third parties responsible for such websites when providing information on a feature or page operated by a third party.
